1. Introduction & Agreement

These Terms and Conditions (“Terms”) govern the purchase of products from SoSaSe Chocolat Ltd, trading as SoSaSe Chocolat® and i Shud KoKo® (“we”, “us”, “our”), through our website www.sosasechocolat.co.uk.

By placing an order on our website, you confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree with any part of these Terms, you must not place an order.

These Terms do not affect your statutory rights as a consumer under UK law. Nothing in these Terms seeks to exclude or limit liability that cannot be lawfully excluded.

2. About Us

SoSaSe Chocolat Ltd is a company registered in England and Wales. We operate from the United Kingdom and supply chocolate products, coloured cocoa butters, lustre dusts, and related items to customers in the UK and internationally.

We are not a member of the European Union. Orders shipped to EU countries are treated as international exports and are subject to the import rules of the destination country.

3. Placing an Order

All orders are subject to acceptance and availability. Placing an order constitutes an offer to purchase; a contract is formed only when we dispatch your order and send you a dispatch confirmation.

We reserve the right to decline or cancel any order at our discretion, including where a product is out of stock, priced in error, or where we have reason to believe an order is fraudulent. In such cases, we will notify you promptly and issue a full refund.

Orders are processed as quickly as possible. During busy periods (including Christmas, Valentine’s Day, and Easter), additional processing time may be required. We will contact you by email if a significant delay is anticipated.

4. Payment

Payment must be made in full at the time of ordering. We will not dispatch goods until payment has been confirmed. Ownership of goods passes to you upon delivery.

Refunds will only be issued to the original payment method used at the time of purchase. We are unable to transfer refunds to a different card, account, or payment provider.

If you raise a chargeback or payment dispute without first contacting us, we reserve the right to defend the dispute and provide these Terms and our correspondence records as evidence. We encourage all customers to contact us directly in the first instance so we can resolve any issues promptly.

5. Pricing & Product Descriptions

All prices are shown in GBP (£). Prices are subject to change without notice, but changes will not affect orders already placed and confirmed.

Product images on our website are for illustrative purposes only. Whilst we make every effort to display colours and details accurately, slight variations may occur due to screen settings, batch variations, or photography conditions. These variations do not constitute a fault.

6. Shipping & Delivery

6.1 Carriers

We ship all orders — both UK domestic and international — using DPD. For international shipments, DPD may hand over to a local delivery partner or national postal service at the destination country. In such cases, a secondary local tracking number may be issued by the partner carrier; we do not always receive this secondary number and cannot guarantee its availability.

6.2 Shipping Costs

Shipping costs are calculated at checkout based on the destination, weight, and dimensions of your order.

6.3 Delivery Timeframes

Estimated delivery timeframes are provided at checkout and are not guaranteed. We are not liable for delays caused by our courier partners, customs processing, public holidays, adverse weather, or other circumstances outside our control.

 

During peak periods (Christmas, Valentine’s Day, and Easter), we ask that you allow an additional 7 working days beyond the stated timeframe before contacting us regarding a late delivery.

6.4 Delivery Address & Contact Information

It is your sole responsibility to provide a complete, accurate delivery address and a valid contact telephone number at checkout. We cannot be held responsible for failed or delayed deliveries resulting from incorrect or incomplete address information provided by you.

If a parcel is returned to us due to an incorrect address provided by the customer:

  • We will contact you to arrange re-delivery at your cost, or
  • We will issue a refund less the original shipping cost, provided the goods are returned to us in satisfactory condition.

If the goods are not returned to us (e.g. they are abandoned or undeliverable), no refund will be issued.

6.5 Failed Delivery & Collection from Depots

If a delivery attempt is made and no one is available to receive the parcel, our courier will typically leave a card with instructions for re-delivery or collection from a local depot or collection point.

It is your responsibility to:

  • Arrange re-delivery or collect your parcel within the courier’s specified timeframe.
  • Monitor tracking updates and act promptly on any instructions left by the courier.

If a parcel is returned to us because it was not collected from a depot or collection point, or because delivery was refused:

  • We will contact you regarding re-dispatch, which will be at your cost; or
  • We will issue a refund less the original shipping costs, provided goods are returned to us in satisfactory condition.

No refund will be issued for goods that are not returned to us as a result of your failure to collect or accept delivery.

6.6 Temperature-Sensitive Products

Our products — including chocolates and coloured cocoa butters — are temperature sensitive. We take reasonable steps to package orders to protect against temperature fluctuations during transit.

However, we cannot guarantee the temperature conditions during postal transit. We are not liable for melting, blooming, or other heat-related changes that occur during delivery, as these are beyond our reasonable control once the parcel has left our premises.

During periods of exceptionally hot weather, we may delay dispatch until conditions are suitable. If this applies to your order, we will notify you by email.

6.7 Once Dispatched

Once your order has been dispatched and is in the care of our courier, we are not responsible for mishandling, loss, or damage caused by the courier. We will, however, assist you in raising any claim with the courier where appropriate.

7. Order Tracking

Once your order has been dispatched, you will receive a confirmation email containing your tracking number. Please check your spam or junk folder if you do not receive this email.

Please note that for some international destinations, a secondary tracking number may be issued by the local delivery partner. We do not always receive this secondary tracking number from the partner courier and cannot guarantee its availability.

If you have not received your tracking information, please contact us and we will provide it as soon as possible.

8. International Orders & Customs Duties

We ship to many countries worldwide. When ordering from outside the United Kingdom, you may be subject to import duties, taxes, customs fees, or other charges levied by your country’s customs authority. These charges are entirely outside our control and are not included in our prices or shipping costs.

It is your responsibility to:

  • Understand and comply with the import regulations of your country;
  • Pay any applicable import duties, taxes, or customs fees; and
  • Provide any documentation required by your customs authority.

EU customers: SoSaSe Chocolat Ltd operates from the United Kingdom. We are not registered for VAT in any EU member state. Any import VAT, customs duties, or handling fees are the sole responsibility of the customer.

We are unable to mark orders as “gifts” or falsify customs documentation. Doing so would be unlawful.

We are not responsible for delays caused by customs clearance, nor for parcels refused or abandoned at customs. No refund will be issued for goods that are seized or destroyed by customs authorities.

9. Lost, Missing & Delayed International Parcels

9.1 Important Notice Regarding International Shipping

International shipping involves multiple carriers, customs authorities, and local delivery partners across different countries. Whilst the majority of orders arrive without issue, international parcels can occasionally be delayed, held, or temporarily untraceable — for reasons entirely outside our control.

By placing an international order, you acknowledge and accept that:

  • International delivery timeframes are estimates only and are not guaranteed;
  • Parcels may be held at customs for inspection for an indefinite period without prior notice;
  • Tracking updates may pause or become unavailable once a parcel passes through customs or transfers to a local delivery partner;
  • A parcel that shows no tracking movement is not necessarily lost — it may be in customs processing or awaiting handover to a local carrier.

9.2 Investigation Timeline — Please Read Before Contacting Us

We understand the frustration of waiting for an international order. However, we are bound by the investigation procedures of our carrier, DPD, and their international partners.

We are unable to open a formal investigation until the following timeframes have passed from the date of dispatch:

  • United Kingdom: 10 working days
  • Europe (EU & non-EU): 15 calendar days
  • Rest of World (USA, Canada, Australia, Asia, etc.): 15 calendar days

These are not arbitrary delays — they are the minimum timeframes required by our carrier before a formal trace or claim can be submitted. Contacting us before these periods have elapsed will not speed up the process, as we are unable to act until the carrier allows us to do so.

We kindly ask that you do not contact us repeatedly about an order that is within these timeframes. We monitor all outstanding orders and will proactively contact you if we receive any update. Repeated contact does not escalate the investigation.

9.3 What To Do While You Wait

  1. Check your DPD tracking link regularly — updates may appear without notification.
  2. Contact your local customs office with your tracking number to check if the parcel is being held for clearance or requires additional documentation.
  3. Check with neighbours, household members, or any secure delivery location at your address.
  4. Ensure your contact telephone number is correct, as DPD or their local partner may attempt to reach you for delivery.
  5. Once the relevant timeframe above has passed, contact us and we will raise a formal investigation with DPD.

9.4 Customs Holds

International parcels are frequently held by customs authorities for inspection. This is a normal part of international shipping and can add days or weeks to delivery. We have no ability to intervene in or accelerate customs processing.

If your parcel is held at customs:

  • You may be contacted by your local customs authority or their appointed broker for payment of import duties or additional documentation.
  • It is your responsibility to respond promptly to any customs requests. Failure to do so may result in the parcel being returned or destroyed.
  • We are not liable for delays caused by customs holds or for goods seized or destroyed by customs authorities.

9.5 Parcels Confirmed Lost or Permanently Delayed

Once DPD has formally confirmed to us in writing that a parcel is officially declared lost or permanently undeliverable, we will contact you to arrange one of the following resolutions:

  • A replacement order (subject to product availability and at our discretion); or
  • A refund to the original payment method.

We are unable to offer refunds or replacements for parcels that are still within the investigation timeframe stated in clause 9.2, or where the delay is caused by customs processing.

10. Returns, Refunds & Faulty Goods

10.1 Perishable & Food Products

Our products are classified as perishable food items. Under the Consumer Contracts Regulations 2013, you do not have a statutory right to cancel or return perishable goods simply because you have changed your mind.

Accordingly, we are unable to accept returns of:

  • Opened or partially used products;
  • Items ordered in error (wrong product, wrong quantity);
  • Unwanted goods where there is no fault with the product.

10.2 Faulty or Incorrectly Supplied Goods

If you believe your order is faulty, damaged, or you have received the wrong product, please contact us within 7 days of receipt with:

  • A description of the issue;
  • Photographic evidence of the fault, damage, or incorrect item;
  • Your order number.

We may require the goods to be returned to us (at your cost) for inspection before a refund or replacement is considered. Where we confirm a fault or error on our part, we will reimburse reasonable return postage costs.

Refunds and replacements for faulty goods are offered at our discretion. We will always aim to act fairly and in accordance with your statutory rights.

10.3 Refund Method

All refunds will be issued to the original payment method used at the time of purchase. We are unable to transfer refunds to alternative cards, accounts, or payment providers.

11. Limitation of Liability

To the fullest extent permitted by law, our total liability to you in connection with any order shall not exceed the total price paid by you for that order.

We shall not be liable for:

  • Indirect or consequential losses;
  • Loss of profit, revenue, or business opportunity;
  • Losses arising from your failure to provide accurate delivery information;
  • Losses arising from delays or damage caused by our courier partners once the parcel has left our premises;
  • Temperature-related deterioration of goods during transit;
  • Losses arising from customs delays, seizure, or refusal.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

12. Events Outside Our Control (Force Majeure)

We will not be liable for any failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to:

  • Strikes, lockouts, or industrial action;
  • Epidemic, pandemic, or government restrictions arising therefrom;
  • Civil unrest, riot, war, or terrorist activity;
  • Fire, flood, earthquake, or other natural disaster;
  • Disruption to transport infrastructure or telecommunications networks;
  • Acts, legislation, or restrictions imposed by any government or regulatory authority.

In such circumstances, we will notify you as soon as reasonably practicable and take reasonable steps to minimise the impact on your order.

13. Live Classes & Masterclasses

The following terms apply to all live online classes and masterclasses offered by SoSaSe Chocolat Ltd:

  • Joining instructions and links will be sent to you by email in advance of the class. It is your responsibility to ensure you are able to access the session.
  • Live classes are not recorded by us. You may not record any class without our express prior written permission.
  • If you are unable to attend a booked class, no refund will be issued. However, we may, at our sole discretion, offer you a transfer to an alternative class date.
  • If you leave a class once it has begun, no refund or transfer will be offered.
  • We reserve the right to reschedule or cancel a class. In the event of cancellation by us, you will receive a full refund or a transfer to an alternative date.

14. Intellectual Property & Trademarks

i Shud KoKo®, SoSaSe Chocolat®, and KoKo Pearls® are registered trademarks of SoSaSe Chocolat Ltd. All rights are reserved.

You may not:

  • Resell, re-brand, or offer our products for resale under our trademarks or as a white-label product without our express written consent;
  • Refill or repurpose our branded packaging (including bottles) with any other product;
  • Use our trademarks, product imagery, or branding in any commercial or promotional context without prior written agreement.

Any breach of these restrictions may result in legal action.

15. Communications & Conduct

We aim to respond to all enquiries promptly during business hours. Please allow reasonable time for a response before following up.

We will not tolerate threatening, abusive, offensive, or harassing communications directed at us or any member of our team. We reserve the right to cease correspondence in such cases and, where appropriate, report matters to the relevant authorities.

We are a small business, and our team may send or respond to emails outside of conventional office hours. We ask that you respond at a time that is convenient to you.

16. Privacy

Your personal data is processed in accordance with our Privacy Policy, which is available on our website. By placing an order, you consent to the use of your personal data for the purposes of fulfilling your order and complying with our legal obligations.

 

17. Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where you are a consumer resident in Scotland or Northern Ireland, in which case you may bring proceedings in your local courts.

18. Changes to These Terms

We reserve the right to update these Terms at any time. The version in force at the time of your order will apply to that order. We encourage you to review these Terms each time you make a purchase.
